2. Scope of these Terms and the products
These Terms apply to orders placed in the HáromSzív Műhely webshop and to the sales contracts concluded there. One party to the contract is the Seller, the other is the person buying in the webshop (hereinafter: Buyer).
The webshop sells handmade door decorations, wreaths, festive and seasonal decorations. The main characteristics, size, material, price and availability of each product are shown on the product page.
The products are handmade and may contain natural materials. Therefore there may be slight differences in colour, shape or pattern between two pieces, and the colours in the photos may look slightly different depending on the screen. These differences are not defects, but they do not limit the Buyer's rights in case of defective performance.
The contract is concluded in the language of the webshop version used for the order (English, Hungarian, Slovak or German). The contract is concluded electronically and qualifies as a written contract. The Seller files it, and the Buyer can access it at any time in the confirmation e-mail.
The Seller does not subscribe to any specific code of conduct.
3. Prices and costs
Prices are shown in Hungarian forints (HUF) or, in the foreign-language versions of the webshop, in euros (EUR). Euro prices are calculated from the forint price at the current exchange rate; the amount payable is the price shown at the time of the order. The Seller is exempt from VAT under the Hungarian small business VAT exemption (alanyi adómentesség); prices therefore do not include VAT and no VAT is payable on them. The price shown on the product page is the total amount payable for the product.
The shipping fee is payable in addition to the price of the product. Before finalising the order, the Buyer can see the total amount payable, including the shipping fee, at checkout.
If a price is obviously displayed incorrectly (for example 0 or a fraction of the usual price), the Seller will inform the Buyer of the correct price. The Buyer can then decide whether to order the product at the correct price or to withdraw from the order.
4. Ordering process and conclusion of the contract
- The Buyer places the selected products in the cart.
- The Buyer enters their name, billing and delivery address, e-mail address and phone number.
- The Buyer selects the shipping and payment method.
- Before sending the order, the Buyer checks on the summary page and, if necessary, corrects the content of the cart, the quantities and the data entered.
- The Buyer accepts these Terms and takes note of the Privacy Policy.
- By clicking the "Order with obligation to pay" button (or a button with the same meaning), the Buyer sends the order.
Sending the order entails an obligation to pay. If the Buyer notices an error in the data after sending the order, they should report it immediately to haromszivmuhely@gmail.com.
The Seller confirms receipt of the order by automatic e-mail. The contract is concluded with this confirmation e-mail. If the Buyer does not receive a confirmation within 48 hours of sending the order, they are released from the order.
The confirmation e-mail contains the order details and the link to these Terms, so the Buyer can view and save the contract terms later.
5. Payment methods
5.1. Advance bank transfer
The Buyer transfers the full amount to the bank account given in the confirmation e-mail, stating the order number as the payment reference. The amount must be transferred within 3 days of the order; otherwise the Seller may cancel the order. The Seller dispatches the parcel after the payment has been received. For deliveries to Slovakia and Austria, advance bank transfer is the only payment method.
5.2. Online card payment (Shoptet Pay)
Where online card payment is offered at checkout, it is processed through the Shoptet Pay payment system (operator: Shoptet Kft., Kacsa utca 15–23., 1027 Budapest, Hungary; card payment services provided by Adyen N.V.). The Buyer can pay by bank card or, where supported by their device, by Apple Pay or Google Pay. The Buyer enters the card details directly on the secure page of the payment provider; they are not passed on to the Seller.
The Buyer is informed of the result of the payment immediately after paying. The Seller does not charge any extra fee for card payment.
5.3. Invoice
The Seller issues an invoice for every purchase and sends it to the Buyer electronically by e-mail.
6. Shipping and delivery
Shipping fees:
- Hungary – GLS home delivery: 2 490 HUF
- Hungary – GLS parcel shop / parcel locker: 1 690 HUF
- Hungary – personal collection in Miskolc or Veresegyház: free
- Hungary – orders over 35 000 HUF: free shipping
- Slovakia: 6.90 EUR
- Austria: 12.90 EUR
- Slovakia and Austria – orders over 120 EUR: free shipping
Parcels to Slovakia and Austria are sent by a courier or postal service chosen by the Seller (for example GLS, Packeta or Magyar Posta). The shipping fee is shown at checkout before the order is finalised.
Average fulfilment times:
- Products in stock are dispatched in careful packaging within 3 working days of receipt of payment.
- Delivery within Hungary usually takes 1–2 working days after dispatch, so the product arrives within 3–5 working days on average.
- Delivery to Slovakia usually takes 3–6 working days and to Austria 3–7 working days from receipt of payment.
For made-to-order products, the Seller will inform the Buyer of the production time before the order. If a product unexpectedly cannot be delivered, the Seller will notify the Buyer immediately and refund any amount already paid within 30 days at the latest.
On receipt, it is worth checking that the parcel is undamaged. If it is damaged, the Buyer should ask the courier to record the damage and also report it to the Seller, preferably with a photo. If this is not done, the Buyer's statutory rights are not lost.
7. Right of withdrawal
A Buyer who is a consumer may withdraw from the contract without giving any reason within 14 days of receiving the product. If several products in one order are delivered in separate parcels, the period starts from receipt of the last product. Withdrawal is also possible between the conclusion of the contract and the receipt of the product.
The withdrawal must be communicated by an unequivocal statement, for example by e-mail to haromszivmuhely@gmail.com or by post. The model withdrawal form at the end of these Terms may be used, but this is not obligatory. The deadline is met if the statement is sent before the 14-day period expires.
The Buyer must send the product back to Csillag utca 14., 3531 Miskolc, Hungary within 14 days of communicating the withdrawal. The Buyer bears the cost of returning the product.
The Seller will refund the full amount paid by the Buyer, including the shipping fee, within 14 days of being informed of the withdrawal. If the Buyer chose a more expensive shipping method than the cheapest standard one, the difference does not have to be refunded. The refund is made using the same payment method the Buyer used, unless the Buyer expressly agrees otherwise. The Buyer does not pay any fee for the refund.
The Seller may withhold the refund until it has received the product back or until the Buyer has proven that it has been sent back, whichever is earlier.
The Buyer is only liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Withdrawal is possible even if the original packaging is missing.
There is no right of withdrawal without reason for products that were not prefabricated but made at the Buyer's express request or according to their instructions, or clearly personalised (for example a decoration with a custom inscription or custom colour choice). If a product is of this kind, the Seller will inform the Buyer before the order. The fact that a product is handmade does not in itself exclude the right of withdrawal.
8. Defective performance: warranty and guarantee
Warranty for defects (kellékszavatosság)
If the product is defective, the Buyer may primarily ask the Seller to repair or replace it, unless this is impossible or would cause the Seller disproportionate extra cost. If the Buyer did not request or could not obtain repair or replacement, they may ask for a price reduction or, in the cases specified by law, withdraw from the contract. Withdrawal is not possible because of an insignificant defect.
For new products, the warranty claim expires two years after performance. A defect discovered within one year of receipt is presumed to have existed at the time of delivery; in this case the Buyer does not have to prove that the defect already existed. The defect must be reported immediately after its discovery; a report within two months of discovery is always considered timely.
Product warranty (termékszavatosság)
In case of a defect of a movable item, the consumer may also ask the manufacturer to repair or replace the product. This claim may be enforced for two years from the placing of the product on the market. A product warranty claim and a warranty claim for defects cannot be enforced at the same time for the same defect.
Guarantee
The rules on mandatory guarantee do not apply to the decorative products sold by the Seller. The Seller does not provide a voluntary guarantee.
9. Complaints and legal remedies
The Buyer can submit a complaint by e-mail (haromszivmuhely@gmail.com), by phone (+36 20 532 4624) or by post (Csillag utca 14., 3531 Miskolc, Hungary).
The Seller will examine and remedy an oral complaint immediately if possible. If this is not possible, or if the Buyer does not agree with the handling of the complaint, the Seller will draw up a record and hand over or send a copy to the Buyer. The Seller will reply to a written complaint in writing, with reasons, within 30 days. If the complaint is rejected, the Seller will indicate which authority or conciliation body the Buyer can turn to.
If the complaint cannot be settled, the Buyer can turn to the following bodies.
Conciliation body:
Conciliation Board of the Borsod-Abaúj-Zemplén County Chamber of Commerce and Industry
- Address: Szentpáli utca 1., 3525 Miskolc, Hungary
- Postal address: Pf. 376., 3501 Miskolc, Hungary
- Phone: +36 46 501 091

- Address: József Attila u. 20., 3527 Miskolc, Hungary
- Phone: +36 46 795 779
- E-mail: fogyasztovedelem@borsod.gov.hu
Consumers living in another EU member state can also ask the European Consumer Centre of their country for help. The Buyer may also enforce their claim in court.
10. Newsletter and electronic advertising
The Seller may send a newsletter with information about new products, seasonal collections, promotions and news of HáromSzív Műhely. The newsletter is free, subscription is voluntary and is not a condition of purchase.
The Seller only sends newsletters to people who have given their prior, express consent (under Section 6 of Hungarian Act XLVIII of 2008 on commercial advertising). Subscription is possible by entering an e-mail address in the newsletter field of the webshop and ticking the consent statement, or by ticking the relevant checkbox during registration or ordering.
The subscriber can withdraw their consent at any time, free of charge and without giving reasons: by clicking the unsubscribe link at the bottom of the newsletters, or by e-mail to haromszivmuhely@gmail.com. After unsubscribing, the Seller will not send any more newsletters to that e-mail address.
Details of the data processing related to the newsletter are set out in the Privacy Policy.
11. Data protection and final provisions
The processing of Buyers' personal data is described in the Privacy Policy available in the webshop.
The Seller may amend these Terms. Amendments do not affect orders placed before they take effect.
Matters not covered by these Terms are governed by Hungarian law, in particular the Hungarian Civil Code (Act V of 2013), Act CVIII of 2001 on electronic commerce, the Consumer Protection Act (Act CLV of 1997), Government Decree 45/2014 (II. 26.) and Government Decree 373/2021 (VI. 30.). This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
